A Chicago mother and her 14-year-old son will no longer face charges after she allegedly ordered him to fatally shoot a man at a hot dog stand.

According to CBS Chicago, charges were dropped against 35-year-old Carlishia Hood and her teen son in the shooting death of Jeremy Brown, 32, which occurred at hot dog restaurant Maxwell Street Express, the Cook County State’s Attorney’s Office said in a statement on Monday (June 26). The mother and son were previously charged with first-degree murder.

Hood and Brown were arguing while waiting for food on June 18 when the mother allegedly texted her son, who was waiting in the car, for help. The 14-year-old teen was accused of using Hood's gun to shoot Brown per her orders.

However, Cook County State's Attorney's Office dropped the charges against the mother-son duo after video surfaced of Brown punching Hood before the fatal shooting. The new video revealed that Brown threatened to beat up Hood if she "said one more thing" before he repeatedly hit her in the restaurant.

Prosecutors said the 14-year-old son was in the doorway watching the assault when he took out the gun and shot Brown in the back. The wounded man attempted to flee the scene but was followed by the Hood and teen, who fired more shots at Brown after his mother allegedly told him to keep shooting him.

Brown later died of his injuries.

“Based upon our continued review and in light of emerging evidence, today the Cook County State’s Attorney’s Office has moved to dismiss the charges against Carlisha Hood and her 14-year-old son,” Monday's statement reads. “Based upon the facts, evidence, and the law we are unable to meet our burden of proof in the prosecution of these cases.”

Hood and her son were released from custody on Monday after the charges were dropped.
