A New Jersey judge has dismissed a lawsuit alleging that a white student faced racial discrimination at school in the wake of George Floyd's death, theGrio reports.
In the lawsuit, the student's father, identified as B.L., accused Mountain Lakes School District (MLSD) of engaging in “a campaign of open racial discrimination” through resources shared with his son and peers following Floyd's death.
Resources allegedly distributed to parents and students by former Mountain Lakes High School Principal Frank Sanchez included a film and brochure that analyzed institutionalized racism and promoted political activism.
The resources highlighted "shibboleths such as ‘white children are receiving coded and sometimes direct messages that all the time about their racial superiority,'" and noted that MLSD had a duty to ‘teach about white peoples roles in perpetuating racism,’” according to the lawsuit.
The lawsuit further alleged that the school district “forced a racial political ideology” on its students, violating their constitutional right to be free from racial or race-based discrimination.
Judge Jessica S. Allen initially dismissed the suit in February, saying the plaintiff must submit an amended complaint in which he identified himself. The plaintiff instead submitted an appeal and motion to stay, which was thrown out by Judge John Michael Vazquez earlier this month.
Vazquez said B.L. lacked standing because his son was no longer a minor and could file his own lawsuit.
Michael J. Fetherman, superintendent of the Mountain Lakes School District, said he was happy with the court's decision to dismiss the suit so officials could return “to what we do best — the education of our children.”
